Emergency Planning and Community Right-to-Know Act (EPCRA) is a federal law designed to help communities prepare for potential chemical emergencies and incidents. It requires industries to report on the storage, use, and release of hazardous chemicals to federal, state, and local authorities.

The law is organized into four core requirements for facilities that meet certain chemical threshold quantities.

Facilities that store, use, or release hazardous chemicals or specific toxic chemicals above certain minimum thresholds established by the EPA. This includes manufacturers, warehouses, distributors, and certain service industries. If your operations handle hazardous chemicals, even in small quantities, it’s important to verify whether EPCRA reporting applies to you.
Tier II falls under Section 312 of EPCRA and mandates facilities to file an annual report by March 1 for the previous calendar year. The report details hazardous chemicals at your facility, including quantities, storage locations, and associated risks. This information helps first responders prepare and respond to chemical incidents.

The Toxics Release Inventory (TRI) program, under Section 313 of EPCRA, requires annual reporting of toxic chemical releases. By July 1 each year, facilities report quantities of specific toxic chemicals released into the environment, treated on-site, recycled, or transferred off-site for disposal. TRI applies to facilities that:

Operate in specific industry sectors (e.g., manufacturing, mining, power generation, chemical wholesale distribution).

Employ 10 or more full-time equivalent employees.

Manufacture, process, or otherwise use any of the approximately 800 listed toxic chemicals above threshold quantities (25,000 lbs for manufacturing/processing, 10,000 lbs for use).
