BSI staff is experienced in providing comprehensive Site Safety Plans for small and large projects.

NYC DOB Site Safety Plan Requirements:

Site Safety Plans are required for construction, demolition and major alterations of the façade on major buildings. Site Safety Plans must include a statement that all workers have completed the required 10-Hour OSHA course and that all workers will have a site-specific safety orientation within seven days of employment.

In accordance with the Chapter 33 of the NYC Building Code, "No permit shall be issued for the construction or demolition of a major building, or for the alteration of the façade of a major building when a sidewalk shed is required until a site safety plan that meets the requirements of Chapter 1 of Title 28 of the Administrative Code has been approved by the Department of Buildings."

Regulatory Compliance Audits (OSHA, EPA, State Regulations)

Code Compliance Services/DOB and ECB Violations and SWO Resolution

We assist clients with compliance to code requirements of NYC DOB, NYC DEP, FDNY, NYS, OSHA, and EPA as it pertains to environmental and safety issues.

BSI’s staff is experienced in addressing and resolving your property’s outstanding DOB (Department of Buildings) and ECB (Environmental Control Board) Violations and SWO (Stop Work Order) Resolutions. Our Professionals are well versed with the NYC Building Code and Compliance Protocols and will work to efficiently address any issues.

Licensed Site Safety Managers (SSM)/Fire Safety Managers (FSM)

Chapter 33 of the New York City Building Code regulates construction operations with regards to the safety of the public and property. Construction and demolition jobs on buildings over 15 stories require a Site Safety Manager on site. We employ a team of experienced Licensed Site Safety Managers and Fire Safety Managers ready to supervise safety of your job.

NYC DOB Building Code outlines the responsibility of the builder/owner, agent, construction manager, or general contractor to designate a site safety manager or coordinator who must be present on a construction or demolition site when required, and who shall be responsible for all site safety requirements of the NYC DOB Chapter 33 "Construction and Demolition". In the event that an alternate manager or coordinator will be acting as the full-time safety manager or coordinator for a period longer than two weeks, the department must be so notified. Any permanent change of site safety manager or coordinator requires immediate notification of the department. No proposed alternate manager or coordinator shall have as his or her primary duty the job of site safety manager or coordinator on any other construction or demolition project.

The FDNY FC Section 1408 now requires a Construction Site Fire Safety Manager (CSFSM) on all New York City projects, as follows: "Where a Site Safety Manager or Site Safety Coordinator is required by the Building Code, the owner shall designate a person to be the Fire Safety Manager for the construction site. The Fire Safety Manager may be the Site Safety Manager or Site Safety Coordinator required by the Building Code. The Fire Safety Manager shall be responsible for ensuring compliance with the requirements of the Fire Code, and the FDNY Rules.  The Fire Safety Manager shall conduct an inspection of the construction site and all fire safety measures on at least a daily basis, and maintain a record of same in a bound book or other approved system of recordkeeping.  The log book or other approved recordkeeping shall be made available for inspection by any representative of the department.  Where fire watch service is provided, the Fire Safety Manager shall be responsible for the general supervision of the fire guards.

A Construction Site Fire Safety Manager shall be present at the construction site at all times when construction, demolition and alteration work is being conducted".

Certified Workplace Safety and Loss Prevention Consultant Services

Industrial Code Rule 59 and 60 of the New York State Department of Labor (NYSDOL) programs directed at addressing workers compensation premiums and costs:

Industrial Code Rule 59 (ICR 59) is directed toward companies with payroll equal to or greater than $800,000 and an experience modification rate (EMR) of more than 1.20. The EMR is a multiplier used to calculate your workers compensation premium. Companies with little or no history start at the industry average rate of 1.0. As a company’s work and loss experience becomes established over the course of several years, its losses are used to calculate a company specific EMR. If it increases above 1.0, that suggests that the company safety performance is below the industry average and the company is paying an insurance surcharge or premium for its coverage. Likewise, an EMR of less than 1.0 suggests that the company is performing better than average for the industry, and the company is basically receiving a discount on their workers compensation premiums. ICR 59 is a mandatory program that companies with elevated EMR’s are required to participate in. If a company does not participate, an additional 5% surcharge is added to its insurance premium each year until compliance is achieved.

Industrial Code Rule 60 (ICR 60) is a program by which companies with successful safety programs can seek to obtain a credit against their workers compensation premiums. The program addresses three programs: Safety Incentive, Drug and Alcohol Prevention and Return to Work. Obtaining NYSDOL approval for all three programs can result in a 10% premium credit the first year and 6% credits each of the next two years with an option to continue participating in the program at the 6% rate for additional cycles.

Companies should consider both programs as a means to reduce their workers compensation costs. While the State will not require Company participation in ICR 59 as long as the company’s EMR is less than 1.20, reducing the EMR from 1.2 down to 1.0 could result in a significant cost savings (e.g. assuming a base premium of $100,000, reducing the EMR from 1.2 to 1.0 would result in a premium reduction from $120,000/yr to $100,000/yr, a $20,000 savings. Further reductions in EMR would result in even more significant savings.
