Permitting can take anywhere from a few months for simple minor permits to over a year for complex major applications, depending on factors such as:

Permit type: Minor source, synthetic minor, major source (Title V), or renewal

Attainment status: Facilities in non-attainment areas face additional requirements and longer review times

Technical evaluations: Air dispersion modeling, BACT (Best Available Control Technology), or RACT (Reasonably Available Control Technology) analyses can extend the timeline

Agency workload and responsiveness: Timelines depend on how quickly the permitting authority reviews and responds
A facility is considered a major source if it emits or has the potential to emit:

100 tons/year or more of any criteria pollutant (e.g., NOₓ, SO₂, CO, VOCs, PM₁₀)

10 tons/year or more of any single hazardous air pollutant (HAP)

25 tons/year or more of any combination of HAPs

Lower thresholds may apply in non-attainment areas, depending on the pollutant and severity of the designation (e.g., 50, 25, or even 10 tons/year for VOCs or NOₓ in ozone non-attainment zones).

Title V permits are comprehensive and federally enforceable, requiring detailed reporting, public participation, and ongoing compliance certifications.
Minor Source Permits apply to facilities that emit below the major source thresholds. They are simpler, faster to obtain, and have fewer ongoing compliance requirements. However, they still require accurate emissions data and adherence to applicable state rules.

Synthetic Minor (Federally Enforceable) Permit: This is a special type of minor source permit where a facility voluntarily accepts enforceable limits (hours of operation, material or fuel use, production throughput, or control efficiency) to avoid Title V classification. These limits are federally enforceable and must be backed by monitoring, recordkeeping, and reporting to demonstrate compliance. This can offer regulatory relief while still maintaining environmental accountability.
