Frequently Asked Questions about EU AI Act Conformity Assessments

A conformity assessment is the process of determining the extent a product, in this case an AI system, meets the EU AI Act applicable requirements. Third party bodies who perform such conformity assessments under the AI Act are empowered to follow the procedure under Annex VII.

If your AI system requires a third-party conformity assessment, it is recommended to utilize an accredited certification body. In doing so, you will be audited by a Global Accreditation Cooperation Incorporated (GACI) recognized organization and your certification may be leveraged for market access internationally.
The assessment is a structured series of reviews aligned to Annex VII including:

Reviewing the technical documentation

Auditing the Quality Management System (QMS)

Assessing model capabilities and datasets, if applicable

This process provides a clear route to demonstrating compliance and supporting EU market access.
Under the EU AI Act, high-risk biometric AI systems must undergo a third-party conformity assessment before they can be placed on the EU market given that the harmonized standards referred to in Article 40 and common specifications referred to in Article 41 are not fully available. Without a successful conformity assessment, the product cannot be legally placed on the EU market.

The service applies to Annex III, point 1 biometric AI systems under the EU AI Act, including:

Remote biometric identification systems

Biometric categorization systems based on sensitive or protected attributes

Emotion recognition systems

Applicability depends on whether the specific system falls within the EU AI Act requirements for third-party conformity assessment. Consideration should be given to Article 43 of the EU AI Act.
Once a positive recommendation has been given to an organization following a conformity assessment, organizations will receive a Union technical documentation assessment certificate and an Article 17 attestation
